The 4th Interstate Application of Cyprus vs Turkey at the European Court of Human Rights

The School of Law and Social Sciences of the Neapolis University in cyprus successfully organized, on Wednesday 18/06/2014 in Nicosia in the Lecture Hall of the Supreme Court, the scientific lecture on “The 4th Interstate Application of Cyprus against Turkey at the European Court of Human Rights”.

Speakers of the conference were the Assistant Professor Mr. John Ktistakis, of the Democritus University of Thrace and Political Sciences University of Bosphorus and District Attorney Ms. Stella Ioannidou. The introduction to the topic of the workshop and the coordinating of the discussion that followed, took Professor Anthony Manitakis, Head of Department of Law Neapolis University in Cyprus and former Minister of Administrative Reform in Greece. The event was honoured by the presence of the current General Attorney of the Republic of Cyprus, Mr. Kostas Klerides.

The speakers stressed the importance of the ECHR judgment, describing it as historical, since it is the first that hat a financial fin as just satisfaction, within a transnational action. Mrs. Ioannidou presented the case-law “previous” that led to the decision of the European public sphere of Human Rights She has also presented the key legal issues raised and managed to present the Cypriot side during the long legal battle in the case “Cyprus vs Turkey” and so led to the successful completion.

Finally, Mr. Ktistakis referred to two key issues relating to the recent decision: She presented both in the legal framework of transnational appeal to the European Convention on Human Rights and the differentiation with respect to individual actions. Secondly, she analysed the issue of execution of judgments of the ECHR. At the same time, she noted the legal and political issues raised after recent refusal of Turkey’s to comply, the operative part of the decision, and because of noncompliance, to date, the decision on the substance of 2001 , 4th Interstate Application of Cyprus vs Turkey.
